This posted information is for the use of our Consumers, ABC Kitchen Appliances – ABC Bosch Direct, known in this policy as the “Company” or “ABC” its employees and management, Vendors, and for those who sub contract with the Company for the following services: delivery, installation, product exchange, repair/maintenance services, and sales. This policy will explain in detail terms of all services offered, warrantees, return or exchanges, acceptable payment methods, business licenses, certifications, bonding and insurance to protect the rights of all parties involved.

Acceptable Payment Methods:


We gladly accept cash, American Express, Discover, MasterCard, and Visa credit cards. The following type of checks will be accepted corporate, personal, cashiers checks only - no third party will be accepted - please see C.O.D. options. C.O.D. also available for "Cash" transactions only. C.O.D. will be automatically utilized for shipping addresses that do not match credit card billing information. Product will be released only after financial institution verification of adequate funds and legitimacy.

Please note: For credit cards given over the phone that have to be manually entered or if the consumer requires mobile credit card machine access, there will be a fee of 3% charged per transaction. Pertaining to purchases outside of the United States; there will be a 5.5% extra charge applied to the total sale for credit card transactions to cover extra fees charged by our card processor. Remember that we offer competitive pricing, free shipping where applicable and stated, and no tax charges out of the state of Utah or country. Attention United States Residents; please review your state residential personal use tax stipulations in regards to out-of-state purchases.


Credit Card Privacy Policy:


Credit Cards

When submitting credit card information; please do not mail or email your credit card number or financial institution information to the Company. If this information is required, please call us directly at 1-801-505-0115 only and choose appropriate extension. When making an on-line or over-the-phone purchase, we do however need the following information:

1.        Credit Card Number and CVC Code.

2.        First & Last name Only.

3.        Complete Mailing Address, where merchandise will be accepted please see “Shipping Policy.”

4.        Complete billing address for credit card payments. This has to be absolute. Credit card companies are becoming very strict in this policy to protect their customers.

5.        Phone number(s) to communicate with you.

6.        E-mail (if applicable) to send you tracking information.


Shipping


Please note the Company does not accept liability due to lost items that have in fact been delivered to your mailing address. Example: You purchase an item from us, we then ship your purchase via UPS or otherwise. You may not be available to sign or personally receive the delivery of your purchase and the package has been left on your front door step. Your package may disappear! Please have us send you your order to a place you will be at physically, or a good neighbor friend, thank you for your understanding. “Protecting your best interests.”


   ABC Bosch Direct is extremely concerned about the safe arrival of our customer shipments. Although we take extra precaution to assist in safe deliveries, we cannot always prevent damage to merchandise in transit. ABC IS NOT RESPONSIBLE FOR SHIPPING DAMAGES CAUSED BY CARRIERS. If you receive a damaged shipment DO NOT SIGN FOR IT UNTIL THE CARRIER MAKES A NOTATION OF DAMAGE ON THE BILL OF LADING. AND IMMEDIATELY contact the carrier office and file a freight claim making sure to find out if they require a physical inspection and any other procedures they may require to process your claim. If you must unpack the merchandise SAVE ANY BOXES AND PACKING MATERIALS, AND DOCUMENT THE DAMAGE! Should you require any assistance to help you process your claim from us, please feel free to contact our Customer Service Personnel.


Arrival of New or Replacement  Appliances Ordered


It may take up to two weeks to receive appliances, and may take longer if appliances are on back order status.  You may take advantage of having appliances expedited at an additional fee (appliance pulled from alternate warehouse out of territory). If you agree to have ABC expedite an appliance and it does not arrive, take into consideration that ABC pays for this as an advantage for our customers and has completed the task in which you have (paid for) asked of us. At that consideration understand that this is a non-refundable service option. No other discounts will be offered. ABC is not liable for any freight, delivery delays, weather, expired rebate programs, or any other things that are beyond our control.

Rebate Policy


ABC is a Rebate Participating Retailer with:

·          Energy Star – Efficient Home Appliances

·          Good Housekeeping

·          Utility Companies – Rocky Mountain Power, Questar Gas, UAMPS, etc.

·          Manufacturers – Bosch, Thermador, ETC.

We are pleased to offer consumer, manufacturer, and/or utility rebate forms and information.  Ultimately,  the customer is responsible to apply for rebates within each rebate program’s specified deadline.  Customer is also responsible for ensuring that their purchase qualifies under the guidelines of each program. 


Pricing Policy


To protect ABC’s pricing and proprietary company information, ABC reserves the right in not disclosing pricing in written form, pricing may be divulged over the phone.  If quotes are given, pricing may be given for the specific item or package with or without the following:  install, delivery, tax, etc.  ABC reserves the right to provide itemized pricing until purchase has been made.   


Return policy:


When a customer would like to return merchandise after purchasing, there are unseen costs (overhead) that consumers are at times unaware of. Inventory purchasing and control, advertising, building leases, warehousing, shipping costs, employees (commissions that cannot be taken away), lots of dedicated time, etc... are just a few reasons why we have created these policies to protect both the consumer and the Company and their representatives. Please understand that our policy is to cover costs formerly stated.


All sales are final.


For large and small appliances, accessories, and parts purchases -all sales are final.  This includes appliances that have been delivered (shipped out-of-state or otherwise) or installed. Parts cannot be returned to manufacturer once ordered by ABC - ALL PARTS ORDERED ARE NON RETURNABLE and NON REFUNDABLE.


All Orders:


1. For appliance orders and high ticket accessories and parts pre-payment is necessary prior to ABC ordering new stock - no exceptions.  Absolutely no return on parts.

2.  Ultimately,  the customer is responsible when ordering parts. Please verify the item SKU # on ABC’s website if applicable to ensure the correct item is being ordered for your small or large appliance.


Customer Pick-Up


If customer is picking-up merchandise, customer must inspect all appliances/merchandise prior to loading - no exceptions. After loading in customer’s vehicle customer releases the Company from: 

1. All material responsibility and liability

2. Cosmetic and/or mechanical damage

3. Missing parts. Please see warranty for electrical malfunction. No exceptions.

Scratch and Dent, Obsolete, and Floor Models


Any merchandise purchased by customer that meets the following criteria: scratch & dent product, floor models, obsolete stock or otherwise are non-returnable and non-refundable - no exceptions. Customer assumes responsibility to provide for replacement of missing parts. ABC can provide sales of missing parts. Sales are final. No returns are accepted, nor will any credit be given. All foregoing merchandise described "may" have warranty coverage, that wholly depends on defect. The Company will not guarantee any type of warranty for this merchandise. Please remember that you are purchasing this type of product at below wholesale costs (at times - over 70% off!) Again, if any replacement parts are required you may purchase thru ABC.



Return Payments (Any Checks, Credit Card, etc)


$50 fee for any return payment, with $5 a day surcharge until funds are restored. Any product or service rendered will be rescinded and subject to repossession, restocking fee, collection costs (liens, etc), and any applicable legal fees which customer will also be responsible for.  This policy does not permit customer to make returns, ALL SALES FINAL.


Manufacturer’s Warranty


ABC’s Disclaimer not applicable to Manufacturer’s Warranty where it will be in full force.  Customer can only make claims for any defects, malfunctions, cosmetic or hidden damage for products within 30 days of purchase.  Claim does not include replacement unless authorized by manufacturer.  Manufacturer’s warranty is non-transferable, only applicable to the end-consumer where original purchase was made from ABC’s stores. For Full Warranty Service where appliance ownership has been transferred you must obtain “Service Authorization” from Manufacturer.


Delivery


A. Where Delivery is included in the appliance sale price or promotion, delivery is only covered in local area within a 20 mile radius, $1.00 per mile charge will be assessed for deliveries outside this area. Delivery will be made to the front door or garage, $40 assessment per appliance per flight of stairs. ABC will not assume any liability for delivery damages made inside of your home.  It is the responsibility of the consumer to adequately prepare the site for delivery or installation. 

Site Preparation Includes but is not limited to:

1.        Making room, moving furniture or fixtures.

2.        Moving breakable items.

3.        Removing doors. (Appliances may not fit in the door dimensions, please measure before your purchase.)

4.        Laying down protection for flooring, carpets, etc.

B.  Where Delivery is purchased separately, not included in appliance sale or promotion.  Prices vary, please inquire within for all inclusion and terms.

C.  Haul Away or removal of existing construction, appliances, hardware, parts, and fixtures for purpose of replacement, repair, and/or upgrades, incurs charges and will not be returned for any reason.  Please inquire for existing rates.  Customer agrees and releases ABC from any and all liability in this matter. ABC recycles appliances, discards all construction debris, or sends removed parts, hardware, and fixtures back to manufacturer. NO EXCEPTIONS


DAMAGES


"Hidden" cosmetic damages such as splintering (due to drilling, hammering, or otherwise), scratches, marking, cracks, holes, tears, etc..., will not be repaired or paid for unless the damage affects surrounding mechanical or electrical components. We take pride in our work, and install or repair appliances as careful as possible. Example: A) dishwasher installation or repair calls for the following: a hole underneath sink (rarely visible) area was made to accommodate drain line. Customer notices that splintering has occurred, but does not affect surrounding area or performance of appliance. This type of scenario happens frequently. Please understand that during installation some alterations may be made to accommodate appliance and the possibilities of the previous said is unavoidable.


 

Return Payments (Any Checks, Credit Card, etc)


$50 fee for any return payment, with $5 a day surcharge until funds are restored. Any product or service rendered will be rescinded and subject to repossession, restocking fee, collection costs (liens, etc), and any applicable legal fees which customer will also be responsible for.  This policy does not permit customer to make returns, ALL SALES FINAL.


Manufacturer’s Warranty


ABC’s Disclaimer not applicable to Manufacturer’s Warranty where it will be in full force.  Customer can only make claims for any defects, malfunctions, cosmetic or hidden damage for products within 30 days of purchase.  Claim does not include replacement unless authorized by manufacturer.  Manufacturer’s warranty is non-transferable, only applicable to the end-consumer where original purchase was made from ABC’s stores. For Full Warranty Service where appliance ownership has been transferred you must obtain “Service Authorization” from Manufacturer.


Installation


Where Delivery is included in the sale price as a promotion, the home must be install ready.

Install Ready Includes but is not limited to:

1.        All plumbing and fixtures (includes connections, hoses, and drains) must already be in place, be in proper working condition (no leaking, or frozen valves) and up to code. 

2.        All electrical outlets, plugs and cords need to be in place or provided by customer.

3.        All gas lines, connections, valves, and fixtures must be in proper working condition and up to code.

Please ask sales or installation personnel for the "installation checklist," it may save you money in terms of repeat trip charges.


Additional Install Charges


For your safety, your protection and for our liability insurance, customer must make all reasonable efforts to make home install ready.  

1.  If ABC performs any work to make home install ready (modifications, purchasing parts, up to code, appliance removal "uninstall") this will incur additional charges.  If customer declines service we reserve the right to refuse installation until site is ready, at this point if installation is rescheduled at a later date, scheduling and trip fees will be applicable.

2.  Delivery/installation charges for "incomplete construction" will incur scheduling and trip fees.  Please inquire for all charges. Mishaps, disasters (fire, floods, etc...) and/or circumstances that are unseen due to economics (bankruptcies, etc...), contractor and/or sub contractor no-shows, layoffs, etc....customers are still subject to all charges incurred by ABC, no returns or offset of any payment for services/products rendered.   

3.  Any install requiring special new tool(s) purchase (ABC keeps tools), customer agrees to cover costs. NO EXCEPTIONS.

4. Haul Away or removal (not to be confused with uninstall of appliances) of existing construction, appliances, hardware, parts, and fixtures for purpose of replacement, repair, and/or upgrades, incurs charges and will not be returned for any reason.  Please inquire for existing rates.  Customer agrees and releases ABC from any and all liability in this matter. SERVICE


Assessment and Trip Fees are non Refundable – ABC charges assessment / diagnostic & trip fees that are not refundable regardless if contracted or not to complete service work.


Extended Warranty Plans


Extended warranties are all about peace of mind, we never forget that. All coverage’s are not the same. ABC’s Extended Warranty Plan provides some of the best coverage available for the lowest price without compromising the service. We have a menu of coverage options available to you. Please check the box applicable to the duration of extended warranty purchased. Extended warranty includes but not limited to the following conditions: Warranties purchased within the first 90 days of appliance purchase will receive a maintenance call within the first six months. General labor fees waived for the duration of the warranty time period purchased. Receive wholesale pricing on replacements parts (new and/or refurbished) stipulated in warranty purchase only. Pay one third of the cost for qualified technicians to perform annual / biennial maintenance (optional purchase). Trip fees apply. Charges may apply if not included in extended warranty contract: labor time exceeding 2 hours, two technicians required, and/or non-warranty coverage on specified parts. All replacement parts have a 30 day guarantee. Manufacturer may extend warranty coverage on new replacement parts.


Appointments


If customer agrees to any service, repair, or diagnosis appointment they agree to all charges that were quoted and any additional or ancillary charges incurred on site (i.e. trip charge fees for “incomplete construction,” additional work needed to bring installation site “up to code,” or any follow-up appointment to complete service repair, etc.)

As with any other service organization we will make every effort to be on time but will not guarantee the time allotted (with factors such as traffic, extended service prior to appointment, etc).  You will be given a window of 2 hours, but may take up to 4 hours.  


Cancellations of Appointments


For confirmed appointments, if the customer needs to cancel, notice must be given within the day before.  If cancellation is made the same day of appointment or customer not available on site you will be billed for 50% amount for the call for local calls, for any long distance calls will be billed 100% of the amount, if applicable. 


Repair Service


At ABC we take pride in our work, if you should find any malfunction in service repair work, ABC reserves the right to investigate by having the circuit boards, motors, parts, or appliances tested, customer agrees to additional charges incurred as result of the investigation (i.e. trip fees, scheduling, service, professional fees, etc.). Any and all items dropped off for repair must be picked up within thirty days from the time of completion of said repair or if unit is not repairable at our facility, otherwise unit will be discarded and/or recycled. We are not responsible for cost and/or replacement of any item that has been either discarded and/or recycled. Please see "Customer Pick-Up."


Unauthorized Service Calls


All ABC technicians have been sub-contracted and are covered under company’s umbrella insurance and proper licensing to perform any appliance repair, HVAC, plumbing, gas and electrical.

When technicians are not authorized to perform service calls and/or are not scheduled by ABC with confirmation from customer, but at the request of customer assesses another appliance or returns to site, the customer releases ABC from any and all liability (this includes any negative actions, misdiagnosis, negligence, material or property damage, etc.) and voids all insurance and licensing technician would be covered if service was authorized by ABC. 

If customer requests assessment of another appliance or any other home repairs ABC is licensed to perform, standard rates apply, and will be charged by ABC to the customer.  No payments or credit card information must not be divulged or rendered to technician.


Same Day Service


If customer require service immediately for the same day for appliances (warranty or non-warranty) and ABC does not have an open appointment, you may take advantage of paying a $105 fee to bump another appointment previously scheduled "if possible". Some customers may not mind, but due to the cost incurred (rescheduling our technicians, paper work, claim submissions, etc.) you must pay for this privilege.


Emergency Service


If customer require emergency service for appliances (warranty or non-warranty) and ABC does not have an open appointment, you may take advantage of paying a $200 fee to bump another appointment previously scheduled "if possible". Some customers may not mind, but due to the cost incurred (rescheduling our technicians, paper work, claim submissions, etc.) you must pay for this privilege.


DAMAGES

Pricing Policy

3. Remember that each manufacturers operations are unique and may require the following: Manufacturer may necessitate the following scenario:  A) Unexpected Price Increases B) Implement additional purchases of attachments, parts, and/or a sequence of parts that may reflect changes in engineering improvements, protocol, and/or specifications. 

4. Any and all parts purchased to complete a service repair call are non returnable to manufacturer and non refundable.


New or Replacement  Parts Ordered


As a general rule, we inform our customers that it may take up to two weeks to receive a replacement part to finish repair of appliance(s). There is no cost to consumer for this type of shipping for MFG warranty service. B) You may take advantage of having parts shipped overnight, your cost will be 25.00 USD to process this service. In some cases, the item may be on back order or otherwise. If you agree to have ABC overnight item and it does not arrive, take into consideration that ABC pays for this as an advantage for our customers and has completed the task in which you have (paid for) asked of us. At that consideration understand that this is a non-refundable service option. If the part itself takes more than two weeks in arrival, ABC "may" offer to discount cost of labor to accommodate customers inconvenience (depending on scenario). No other discounts will be offered. C) If part is late for full warranty coverage (labor charges inclusive), ABC cannot offer any other accommodations. If this is the case, and your inconvenience is great and frustrations are high, please call us at 801-505-0115 to direct you to the appropriate channels. NO EXCEPTIONS.

HVAC


Contracted under $1000.00 ONLY. Total price must include "parts" and "labor," stipulated under Utah HVAC HM Code. All price quotes subject to change (i.e. material cost fluctuation, residential/business construction, hidden pipes, electrical, duct work, transportation cost, etc.) Once quote has been finalized, ABC reserves the right to adjust costs for materials, transportation, and labor. Damages (visible or hidden) are subject to same policy standards as found under installation and delivery.


DAMAGES


"Hidden" cosmetic damages such as splintering (due to drilling, hammering, or otherwise), scratches, marking, cracks, holes, tears, etc..., will not be repaired or paid for unless the damage affects surrounding mechanical or electrical components. We take pride in our work, and install or repair appliances as careful as possible. Example: A) dishwasher installation or repair calls for the following: a hole underneath sink (rarely visible) area was made to accommodate drain line. Customer notices that splintering has occurred, but does not affect surrounding area or performance of appliance. This type of scenario happens frequently. Please understand that during installation some alterations may be made to accommodate appliance and the possibilities of the previous said is unavoidable.



Return Payments (Any Checks, Credit Card, etc)


$50 fee for any return payment, with $5 a day surcharge until funds are restored. Any product or service rendered will be rescinded and subject to repossession, restocking fee, collection costs (liens, etc), and any applicable legal fees which customer will also be responsible for.  This policy does not permit customer to make returns, ALL SALES FINAL.


Manufacturer’s Warranty


ABC’s Disclaimer not applicable to Manufacturer’s Warranty where it will be in full force.  Customer can only make claims for any defects, malfunctions, cosmetic or hidden damage for products within 30 days of purchase.  Claim does not include replacement unless authorized by manufacturer.  Manufacturer’s warranty is non-transferable, only applicable to the end-consumer where original purchase was made from ABC’s stores.   For Full Warranty Service where appliance ownership has been transferred you must obtain “Service Authorization” from Manufacturer.

 

DO IT YOURSELF REPAIR


If customer decides to do the following:

● Do-It-Yourself Repair – Consumer performs repair on home appliance, Company will limit information given (i.e. product computer settings, reset system, interface testing, motor, and electronic testing, etc…) that require a trained professional to assess. In general this information is not given to consumer to protect interests of the Manufacturer and ABC from liability arising from an unlicensed repair attempts by the customer.

● Purchase replacement parts – Consumer performs repair/replacement of malfunctioning part.

RELEASE OF LIABILITY

AGREEMENT GOVERNING PURCHASE AND USE OF SPARE PARTS, TECHNICAL SUPPORT VIA ELECTRONIC MAIL AND/OR BY TELEPHONE

This agreement is made by and between The Company (“ABC”) having a principle place of business at 2451 South 600 West #300, Salt Lake City UT 84115, and the undersigned (“Customer”), whose name and address appears below (please fill out required fields).
Customer desires to perform repair to home appliance, to purchase or obtain spare parts in order to replace parts that have become damaged or are defective. In exchange for the right to receive technical support from ABC and/or obtain spare parts, Customer acknowledges and agrees to the following terms and conditions:
1. Risk of Repair. CUSTOMER ACKNOWLEDGES THAT PRODUCTS MAY CONTAIN INTERNAL POWER SUPPLIES THAT ARE EXPOSED WHEN THE UNIT IS OPENED. CUSTOMER FURTHER ACKNOWLEDGES THAT OPENING UNIT CAN RESULT IN RISK, AND IF NOT PROPERLY PERFORMED, POSSIBLY INJURY OR DEATH TO USER. ACCORDINGLY, CUSTOMER AGREES THAT OPENING UNIT AND REPLACING COMPONENTS CAN BE EXTREMELY DANGEROUS AND THAT CUSTOMER IS PROCEEDING AT THEIR OWN RISK.
2. Repair by Qualified Technician Only. Customer agrees that products are not intended to be opened by the general user and that any replacement of damaged or defective components should only be performed by a qualified technician.
3. Release of All Claims Against The Company. Customer hereby agrees to release The Company from any and all claims and liabilities for personal injury or property damage, including damage to the unit under repair or other equipment, which occurs as a result of either opening or replacing components.
4. No Liability for Consequential Damages. IN NO EVENT SHALL The Company BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE USE OF TECHNICAL SUPPORT, SPARE PARTS OR DEFECTS IN THE PRODUCT, INCLUDING LOST PROFITS, DAMAGE TO PROPERTY AND, TO THE EXTENT PERMITTED BY LAW, DAMAGE FOR PERSONAL INJURY, EVEN IF The Company HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The Company LIABILITY FOR ANY CLAIM, LOSSES, DAMAGES OR INJURY, WHETHER CAUSED BY BREACH OF CONTRACT, TORT, OR ANY OTHER THEORY OF LIABILITY, SHALL NOT EXCEED THE FEE PAID BY YOU FOR THE SPARE PARTS.
5. Termination of Warranty on Products. Opening products or replacing components may cause damage to the unit itself or its components. Customer agrees that it will bear sole responsibility for any damage occurring during the component replacement process, and that any such damage will void any warranty rights it may have in the unit. Customer agrees to be bound by manufacturer’s and The Company decision to deny warranty coverage for any portion of unit under repair damaged by Customer’s replacement of spare parts.
6. Warranty on Spare Parts. The Company warrants that the spare parts conform substantially to the specifications contained in the product documentation when used in accordance with the specifications of the unit under repair for one (1) year from the date of original purchase from an authorized resellers. In the case of a valid warranty claim, your sole and exclusive remedy and The Company entire liability under any theory of liability will be, at it’s option, to repair or replace the part(s) without charge or, if not possible, to refund the purchase price to you. This warranty is not transferable; it applies only to the original purchaser of the product. The Company will not accept responsibility for loss or damage in transit. This warranty is void if the product serial numbers have been removed from the product or if the product has been damaged by misuse, modification or unauthorized repair.
7. No Resale of Spares Kits and No Assignment. You agree that you will not resell or offer to others use of spare parts without first: (1) notifying the Company, (2) obtaining a signature on a Release of Liability form identical to this form, and (3) returning a signed form to the Company Customer Support by fax at 801-568-0488. Recipient will not assign or transfer any rights or obligations under this Agreement without the prior written consent of the Company.
8. Governing Law. This agreement shall be governed by and construed in accordance with the law of The United States. The parties irrevocably submit for the benefit of the Company to the exclusive jurisdiction of the Courts of The United States and Utah in respect of any claim, dispute or difference arising out of or in connection with this agreement or any Contact.
9. Entire Agreement. This agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous oral or written agreements with respect to the subject matter contained herein. This Agreement may only be changed by mutual agreement of authorized representatives of the parties in writing.

10. Customer agrees to pay the full charge of $69.95 immediately prior receipt of services offered by ABC’s Technical Support. This service is valid for eighteen (18) months pertaining to initial appliance consumer/customer inquires of and is non-refundable regardless of satisfaction - no exceptions. You must identify model and serial numbers (“FD” #’s) for each call-in. Effective date same as date of

confirmation acceptance.
